Terms of Service

1. Introduction

Welcome to Evidence Chain ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Evidence Chain mobile application and services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms.

2. Eligibility (18+ Only)

The Services are strictly for adults.

  • Age Requirement: You must be at least 18 years of age to use the Services.
  • By creating an account, you represent and warrant that you are 18 years or older.
  • If we discover an account belongs to a user under 18, we will immediately terminate the account and delete all associated data.

3. The Nature of the Service

Evidence Chain is a digital evidence capture and storage tool.

  • No Public Feed: The Services allow for the capture and secure storage of photos and videos ("Content"). Content is not displayed on a public feed.
  • Chain of Custody: The primary purpose of the Service is to preserve metadata (time, date, location) to authenticate the Content.
  • Credits and Storage: The Services operate on a credit-based system. Purchasing a credit grants you the right to store specific Content for a set period of time as defined at the point of purchase. Failure to maintain sufficient credits or renew storage periods may result in the deletion of your Content.

4. User Rights and Content Ownership

  • You Own Your Content: You retain all ownership rights to the evidence you capture.
  • Limited License to Us: We do not claim a right to broadcast your content. You grant Evidence Chain a limited, non-exclusive, worldwide, royalty-free license solely to host, store, secure, and backup your Content as requested by you, and to generate the unique URL links necessary for you to share your Content with third parties.

5. Prohibited Content and Conduct

You are solely responsible for the Content you capture and store. To maintain the integrity of the Service, strictly prohibited actions include:

  • Illegal Content: You may not store Content that violates the laws of the jurisdiction in which the Content was created or stored. This includes, but is not limited to, Child Sexual Abuse Material (CSAM), depictions of suicide, or content promoting terrorism.
  • Hate Speech: Content promoting, encouraging, or inciting violence or hatred against individuals or groups based on race, religion, gender, or other protected characteristics is prohibited.
  • Minors: The depiction of any individual under the age of 18 in a sexualized, compromising, or exploitative manner is strictly prohibited.
  • Pornography: The storage of pornography or sexually explicit material for recreational or entertainment purposes is prohibited.
  • Violence and Gore:
    • Allowed: Dispassionate capture of injuries, crime scenes, or accidents strictly for legal, medical, or evidentiary documentation.
    • Prohibited: Content that encourages violence, celebrates suffering, or is captured for the purpose of entertainment or harassment.

6. Enforcement and Termination

  • Zero Tolerance: We reserve the right to review Content if flagged for violations. We have a zero-tolerance policy for CSAM and illegal content.
  • Breach of Terms: If you violate these Terms—specifically regarding prohibited content or age restrictions—we reserve the right to immediately suspend or permanently delete your account and all associated Content without refund of any credits.
  • Law Enforcement: We may report illegal activity and cooperate with law enforcement authorities if required by law.

7. Data Integrity and Disclaimer of Warranties

  • "As Is" Service: The Services are provided "as is". While we utilize advanced hashing and metadata locking techniques to ensure the authenticity of your evidence, technology evolves rapidly.
  • No Guarantee of Immutability: Evidence Chain does not warrant that the Content or metadata is absolutely impossible to modify by sophisticated third-party actors or state-level interference. You acknowledge that Evidence Chain is a tool to assist in authentication, not an absolute guarantor of legal admissibility or immutability.
  • Liability: We are not liable for the rejection of your evidence in a court of law or for any third-party attempts to spoof or alter data outside of our secure environment.

8. Limitation of Liability

To the fullest extent permitted by law, Evidence Chain shall not be liable for any indirect, incidental, or consequential damages, including loss of data or evidence. Our total liability to you for any claim arising out of these Terms or use of the Services is limited to the amount you paid us for Credits in the 12 months preceding the claim.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
